General terms and conditions
for working with landlords and hotels

1. General information/scope
The general terms and conditions (T & C) for the marketing of holiday homes and hotels by Focasa GbR (hereafter referred to as Focasa) compared to the providers of such properties are laid down below.

2. Focasa Services
Focasa will put the range of properties available online on the Internet for interested visitors on the basis of the information provided. Focasa therefore reserves the right to make amendments to the services agreed on, as long as such amendments do not affect the core services and show responsibility towards the interests of the contract partner.
We offer you disk space on our home page www.focasa.de and in our forum www.focasa-forum.de with a direct link to your home page, a place for your company logo and a photo (122x84 pixels) as well as sufficient space for an informative text.

3. Placing the order/awarding of contracts
Once the registration form has been sent on the internet page www.focasa-forum.de and the order connected to it has been placed, a licensing agreement between Focasa and the customer comes into effect. The minimum contract duration is 12 months.
The contract will be automatically extended by a further year unless it is terminated by Focasa or the customer at a deadline of one month before the end of the contract year.

4 .Guarantee, liability
Customers are fully responsible for the content of their web presence. They are obliged to inform us on time if relevant content in the information made available to Focasa has changed.
This applies to the URL for linking up with our pages in particular. Customers are also obliged to ensure that the content of their web pages do not violate the rights of third parties (e.g. personal rights, naming rights, trademarks, etc.) or any existing laws.
In case of violation, Focasa is entitled to terminate the contract without notice. Claims for guarantees towards Focasa are limited to subsequent execution.
If subsequent execution fails, the provider can withdraw from the contract in accordance with § 634 No.3 BGB or reduce the payment and demand compensation for damages or compensation for futile expenditure in accordance with § 634 Nr.4 BGB.

5. Prices/payments
The prices for the individual Focasa services depend on the prices valid in the registration form at the time of placing the order.
In case of an automatic extension of the contract duration, payment is determined by the extended contract duration based on the price in the registration form in each case which is valid for the customer two weeks before the start of the termination period.
Payments are due immediately after receipt of the invoice.
In case of delays in payment or deferrals, interest as per the law will be charged.
If payment is delayed, Focasa reserves the right to withhold its own contractual obligations until the payment has been made.
Any costs borne by Focasa whilst trying to obtain payment or return debit notes will be charged further.

6. Termination
Termination must be made in writing (by E-mail, letter or fax).

7. Jurisdiction
If the provider is a business as per the commercial code, Focasa's head office is the jurisdiction for all disputes arising out of the contractual relationship.

8. Amendments to these T & C, Severability Clause

9. Focasa reserves the right to amend these T & C at any time without providing reasons. The amended conditions will be sent to the user by E-Mail two weeks before they come into effect. If the user does not contradict the scope of the new T & C within two weeks of receiving the E-mail containing the amended conditions, the amended T & C count as accepted. Focasa will point out the significance of this two week period separately in the E-Mail containing the amended conditions.

10. If any of the terms included in these T & C are ineffective, the remaining terms will be unaffected.
The ineffective terms can be replaced by terms that come closest to them legally and economically. The same applies to any regulation loopholes.
